Ashlee Simpson and Pete Wentz, who split earlier this year, are headed to court to determine custody of their two-year-old son Bronx. According to TMZ, the couple is about to be embattled in a custody case following what many assumed was an amicable breakup.

Wentz reportedly filed papers this week in response to Simpson’s divorce petition. Simpson had requested primary physical custody of Bronx, but Wentz has filed new documents that request joint physical and legal custody. TMZ, who says they have obtained these documents, report that the papers were filed in the L.A. County Superior Court and ask that each party pay their own legal fees. This goes against Simpson’s petition which asks Wentz to foot the bill for both sides.

Simpson’s papers allegedly don’t offer a date of the couple’s breakup, but Wentz cites February 9th as the date of their split. The news of the divorce emerged last month and several sources said the couple, who married in May of 2008, were still on good terms. A source told People last month, “It’s very amicable. They’re on very friendly terms and speaking— it’s fine. They’ve just grown apart. They’ve been growing apart for quite some time.”

The source also mentioned that both parties are very focused on parenting. “It’s all about Bronx for them,” the source told People. “They’re fantastic parents— Pete says she’s a great mom, and she says he’s a great father. It’s about Bronx’s care and well-being and happiness for them.”

A presumably different source spoke to TMZ about the issue last month, offering a slightly different version of the story. “It’s really all about Pete’s erratic behavior,” the source said. “She really wanted out.”

Either way, we hope the courts do what is best for Bronx.
