James Holden, the man accused of killing 12 people and injuring 58 others at a midnight screening of The Dark Knight Rises, was charged with 24 counts of murder, 116 counts of attempted murder, one count of possession of explosives and one count of committing a crime of violence this morning.

Craig Silverman, former chief deputy district attorney in Denver, told the AP: “I don’t think it’s too hard to predict the path of this proceeding … This is not a whodunit. … The only possible defense is insanity.”

Although defendants in Colorado are not legally responsible for their acts if they cannot differentiate between right and wrong, the AP emphasized that “care should be taken not to confuse such mental disease or defect with moral obliquity, mental depravity, or passion growing out of anger, revenge, hatred, or other motives, and kindred evil conditions”. Holmes is not expected to enter a plea.
